WHEN CAN YOU SUE FOR UNPAID WAGES AND UNREASONABLE/ILLEGAL WORK HOURS?

Wage and hour disputes occur regularly in workplaces across Los Angeles and Southern California. They may involve unfair practices in the workplace, violations of the Fair Labor Standards Act (FLSA), and workers not collecting their legally or contractually promised wages. The following are the more common examples: 

Independent Contractor or Subcontractor Misclassification

Employers may misclassify employees as independent contractors or subcontractors to avoid taxes and business costs. However, these workers do not have the same legal protections and benefits that “regular” employees receive regarding overtime pay and breaks for rest, meals, and lactation.

Rest and Meal Break Denials

California non-exempt employees are entitled to a 30-minute meal period for every five hours worked and a 10-minute rest period for every four hours. These breaks are critical for workers’ health. If an employer denies these periods, they are responsible for paying an hour’s wages for each missed day.

Minimum Wage Violations

The Fair Wages and Healthy Families Act requires employers to meet the minimum wage standard of $16.50 per hour, regardless of whether employees are paid hourly, by commission, or with a salary. Still, some employers break the law by paying workers far less.

Overtime Violations

In California, non-exempt employees are entitled to overtime pay, generally 1½ times the regular rate of pay, if they work more than eight hours in a workday or more than 40 hours in a workweek. A business could be liable for paying double that amount — or more — if they violate overtime law.

Expense Reimbursements

Most jobs require workers to have equipment, uniforms, and other necessary gear, as well as utilize services such as cellular and travel. However, some employers make their workers personally pay for these when they’re actually entitled to reimbursement under state labor law.

Other examples of unpaid wages and work hour violations include the following:

  • Failure to follow employment contract terms
  • Making employees “clock out” but continue working
  • Not paying the right rate for all of a worker’s hours
  • Unlawful deductions taken from paychecks
  • Not getting vacation and sick pay 
  • Denying commissions and bonuses
  • Nonpayment of commission upon termination
  • Being required to share tips or having tips stolen
  • An employer filing for bankruptcy but still owing wages
  • Not obtaining a final paycheck at the end of employment
